In NSW, for example, vehicles with applicable ADR 83/00 certification are assessed using the vehicle's ADR 83/00 stationary signature level, with the prescribed level generally being that signature level plus 5 dB(A), subject to the applicable transitional rules.
Queensland similarly provides that a vehicle certified to ADR 83/00 must not exceed its certified stationary noise level by more than 5 dB(A).
That is why simply saying “90 dB is legal in Australia” can give enthusiasts the wrong impression. The applicable requirement depends on the vehicle and the regulatory framework being used.
What Does dB(A) Actually Mean?
Before discussing exhaust limits, it helps to understand what the numbers mean.
What is a decibel?

The problem is that it is often taken out of context.
For example, NSW EPA guidance states that for vehicles not certified to ADR 83/00, cars built on or after 1 January 1983 have a prescribed maximum of 90 dB(A), while cars built before that date have a 96 dB(A) limit.
But ADR 83/00 introduced a different framework for vehicles certified to the standard.
ADR 83/00 is Australia's External Noise design rule. Its purpose is to establish limits for external noise generated by motor vehicles, motorcycles and mopeds.
The standard includes:
- Drive-by noise testing
- Stationary noise testing
- Vehicle-specific noise certification
- A stationary noise “signature” value
This means a newer ADR 83/00-certified vehicle cannot necessarily be judged by simply asking whether its exhaust measures below 90 dB(A). Its applicable certified noise value needs to be considered.

Australian Exhaust Noise Rules: Why Your State Matters
Australian vehicle standards operate alongside state and territory registration and enforcement frameworks. That means every car enthusiasts should not assume that a rule they read about in another state automatically applies to their vehicle.
New South Wales
NSW provides a useful example of why the 90 dB assumption can be misleading. NSW EPA guidance states that:
- Cars built before 1 January 1983 have a maximum prescribed noise level of 96 dB(A).
- Cars built on or after 1 January 1983 and not covered by ADR 83/00 have a 90 dB(A) maximum.
- Applicable ADR 83/00-certified vehicles are assessed using their ADR 83/00 signature level plus 5 dB(A), subject to transitional provisions.
NSW also has an enforcement process for reported noisy vehicles.
If the EPA believes a vehicle is exceeding the applicable legal noise level, it can issue a Vehicle Inspection Notice (VIN) requiring the vehicle to be taken to an approved inspection station. The inspection can include both noise testing and inspection of pollution-control devices.
Queensland
Queensland regulations also distinguish between vehicles certified to ADR 83/00 and vehicles that are not. For applicable ADR 83/00-certified vehicles, the stationary noise level must not exceed the certified level by more than 5 dB(A). Queensland regulations also require internal-combustion motor vehicles to have a silencing device through which the engine exhaust passes.
Other states and territories
Victoria, Western Australia, South Australia, Tasmania, the ACT and Northern Territory have their own vehicle standards, registration requirements and enforcement arrangements. The important takeaway is not to memorise a single number.
Instead, identify: Your vehicle → its build/certification status → your jurisdiction → the applicable noise requirement.
That is the safer way to approach an exhaust modification.
What Happens If Your Exhaust Is Too Loud?
The consequences vary according to jurisdiction and circumstances, but excessive vehicle noise can become more than an annoying conversation with a neighbour.

- Choose the complete exhaust system carefully.
- Don't rely on a generic dB claim or smartphone reading.
And most importantly, don't assume that louder automatically means better.
